Your data will be stored and processed in whole or in part in the United States. If you access an Evoca website outside the United States, your usage of the Evoca site constitutes consent to the transfer of your data out of your country and to the United States.
The Evoca service enables you to make recordings and store them on our computer servers. Evoca is a passive venue. The decision whether to record and store content and whether to make it available to others through our site is under your sole control. We do not control whether a recording is made and stored, or, except in very limited circumstances, whether its contents are disclosed to third parties.
Evoca processes recordings that our users control. Evoca will not, other than for the purposes of hosting and providing the Evoca Service (including conducting maintenance and quality assurance) as requested by or on behalf of, and under the control of, our users:
* Record any conversation
* Use or access the contents of any recorded conversation
* Disclose the contents of any recorded conversation for any purpose (except if required to do so by law or in connection with a change in ownership or sale of our assets described in the “Disclosures” section below).
Collection of Recordings and Other Information
If you decide to record content, this information will be collected and stored on our site, under your control.
In some areas of our website, Evoca requests that you provide personal information, including your name, address, e-mail address, telephone number, credit card number, contact information, billing information and any other information from which your identity is discernible.
In other areas, Evoca collects or may collect demographic information that is not unique to you such as your ZIP code, age, preferences, gender, interests and favorites. Sometimes we collect or may collect a combination of the two types of information.
Examples of areas on the Evoca website where we collect personal or combined personal and demographic data are pages where you can open an Evoca account, make a purchase of a translation of transcription, or make a purchase of “premium content”. We also gather or may gather certain information about your use of our site, such as what areas you visit and what services you access.
Moreover, we may collect, information about your computer hardware and software including without limitation your IP address, browser type, domain names, access times and referring website addresses.
Retention of Recordings
If you request that we delete a recording that you stored on our servers, Evoca will delete that recording permanently including any back-up copies we may have made of that recording.
For Free Member accounts we will delete the recordings and close the account if there have been no new recordings posted to the account by the member for 12 months.
For Pro Member accounts, we keep the recordings as long as they pay their fees. The Member is always free to remove his/her recordings.
Disclosure of Recordings and Other Information
You control whether the contents of a recording that you have made using our service are available to others, except in the limited circumstances described below in this section.
Please remember that if you make your recording available to others or if you post any of your personal information in public areas of the Evoca website, such as in online forums, groups, or through comments, such information may be collected and used by others over whom Evoca has no control. We are not responsible for the use made by third parties of information you post or otherwise make available as an Evoca user in public areas or in private groups to which you choose to belong.
We may disclose the contents of communications that you store on our site only to respond to lawful process, or as otherwise required by law. In the event of a merger, consolidation, sale of our assets or other corporate change, a new entity would control the servers on which user recordings are stored, but would be subject to these same disclosure limitations.
However, we may disclose personally identifiable information about our users, in response to legal process or when otherwise legally required to do so, to verify or enforce compliance with the policies governing our website and applicable laws, or to protect against misuse or unauthorized use of our website. We also may disclose user information whenever we believe disclosure is necessary to limit our legal liability; to protect or defend our rights or property; or to protect the safety, rights, or property of our users.
We may also sell, transfer, or otherwise disclose user information, including personally identifiable information, to a successor entity in connection with a corporate merger, consolidation, the sale of substantially all assets, or other corporate change respecting our service or website.
We may record and share aggregated information with our partners and member companies.
We employ other companies and individuals to perform functions on our behalf. Examples may include hosting our web servers, analyzing data, providing marketing assistance, processing credit card payments, and providing customer service. These other companies and individuals may have access to your personal information as necessary to perform their functions, but they are required to protect this information in a manner that is consistent with this privacy notice by, for example, not using the information for any purpose other than to carry out the services they are performing for us.
Security of Recordings and Private Information
Evoca has implemented appropriate technical and organizational measures for the protection of recordings and other personal information we process through our website against accidental or unlawful destructions or accidental loss, falsification, unauthorized dissemination or access, and against other unlawful forms of processing.
Evoca uses temporary “cookies” to help personalize and maximize your online experience and online time. A cookie is a text file that is placed on your hard drive by a web page server. Cookies are not used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to your computer, and can only be read by a web server in the domain that issued the cookie to you. Evoca s cookies are ordinarily deleted automatically when you log off of the Evoca website.
You may have the ability to accept or decline cookies. Most web browsers automatically accept cookies, but you can usually modify your browser setting to decline all cookies if you prefer. Alternatively, you may be able to modify your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. If you choose to decline cookies, however, that may hinder performance and negatively impact your experience on the Evoca website.
Protection of Children
Evoca is not intended for children under 13 years of age, and Evoca does not knowingly collect personal information from children under 13. Children must obtain the consent of a parent before signing up for the Evoca service or giving out personal information online.
